1. Agreement to Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Dietk ("Dietk", "we", "our", or "us") governing your access to and use of the Dietk mobile application and website at dietk.app (collectively, the "Service").

By creating an account, downloading the app, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Dietk is a mobile application that helps users track nutrition, log meals via text and photo, and receive AI-generated nutrition guidance. The Service is provided for general wellness and informational purposes only.

THE SERVICE IS NOT MEDICAL ADVICE. READ THIS SECTION CAREFULLY.

Dietk is a general wellness tool, not a medical device. The information, calorie estimates, nutritional values, photo analyses, and AI-generated guidance provided through the Service:

• Are estimates and approximations, not exact measurements
• Are NOT a substitute for professional medical, dietary, or psychological advice
• Are NOT intended to diagnose, treat, cure, or prevent any disease or condition
• Should NOT be relied upon for medical decisions

You should consult a qualified physician, registered dietitian, or other licensed healthcare professional before:

• Starting any diet, weight-loss program, or nutritional regimen
• Making changes to existing nutritional plans
• Using Dietk if you have or suspect any medical condition, including but not limited to: diabetes, eating disorders, kidney or liver disease, heart conditions, pregnancy, lactation, or any condition affecting metabolism or nutrient absorption
• Using Dietk for any child or minor under your care

Do not use Dietk in connection with any eating disorder. If you are struggling with disordered eating, please contact a qualified healthcare professional immediately.

By using the Service, you acknowledge that you are using it at your own risk and that we are not liable for any decisions you make based on information provided by the Service.

4. Eligibility

To use the Service, you must:

• Be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher)
• Have the legal capacity to enter into a binding agreement
• Not be barred from using the Service under any applicable law

If you are under 18, you must have a parent or legal guardian's permission to use the Service.

5. Your Account

You are responsible for:

• Providing accurate information when creating your account
• Keeping your login credentials secure
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

We may suspend or terminate your account if you provide false information, violate these Terms, or use the Service in ways that harm us or other users.

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Submit content that is illegal, harmful, harassing, threatening, defamatory, obscene, or infringes the rights of others
• Submit images of anything other than food in good faith (no inappropriate, sexual, violent, or illegal images)
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Use automated tools, scrapers, or bots to access the Service
• Bypass any security measures or rate limits
• Resell, sublicense, or commercially exploit the Service without our written permission
• Use the Service to develop a competing product
• Interfere with the operation of the Service or the experience of other users

We reserve the right to remove content and suspend accounts that violate these rules, without notice.

7. User Content

You retain ownership of the content you submit to the Service (photos, text messages, food logs, etc.) ("User Content").

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content solely for the purpose of operating and providing the Service to you. This license terminates when you delete your User Content or your account.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe any third-party rights
• Your User Content complies with these Terms

We are not obligated to monitor User Content but reserve the right to remove any content that violates these Terms.

8. AI-Generated Content

The Service uses artificial intelligence (currently Anthropic's Claude API) to analyze food images and generate coaching responses. You understand and agree:

• AI outputs are estimates and may contain errors
• AI outputs do not constitute professional advice
• We do not guarantee the accuracy of any AI-generated content
• AI outputs are generated based on patterns in training data and may not reflect your specific circumstances

9. Intellectual Property

All intellectual property rights in the Service — including the app, website, brand, logos, text, graphics, software, and design — are owned by us or our licensors. These Terms do not grant you any rights to our intellectual property except a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes.

The Dietk name and logo are trademarks of Dietk. You may not use them without our prior written consent.

10. Pricing and Payments

The Service is currently provided free of charge, subject to certain usage limits (for example, daily limits on AI photo analysis).

We may introduce paid features, subscriptions, or other monetization in the future. If we do:

• Pricing and payment terms will be disclosed clearly before you purchase
• Subscriptions will renew automatically until cancelled, unless stated otherwise
• Refunds will be handled according to the applicable app store's policies and applicable consumer law

11. Service Availability and Modifications

We strive to keep the Service available but do not guarantee uninterrupted access. The Service may be unavailable from time to time for maintenance, updates, or due to factors beyond our control.

We may add, change, or remove features of the Service at any time. We may also discontinue the Service entirely, in which case we will provide reasonable notice where possible.

12. Termination

You may stop using the Service and delete your account at any time inside the app: Settings → Delete Account.

We may suspend or terminate your access to the Service if:

• You violate these Terms
• We are required to do so by law
• We discontinue the Service

Upon termination, the licenses you have granted us under Section 7 will continue only to the extent necessary to deliver the Service to other users (in which case your data is anonymized or aggregated). All other rights granted to you under these Terms will cease.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or accurate.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• We are not liable for lost profits, lost data, or business interruption
• Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of: (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD 100)
• We are not liable for any harm resulting from your reliance on AI-generated content or any health-related decisions made based on the Service

Nothing in this section limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Dietk, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your User Content
• Your violation of any rights of a third party

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of (to be specified), without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through (to be specified). The language of any proceedings shall be Arabic or English at our discretion.

Nothing in this section prevents either party from seeking urgent injunctive relief in any court of competent jurisdiction.

17. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.

18. No Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

20. Changes to These Terms

We may update these Terms from time to time. When we do:

• We will update the "Last updated" date
• For material changes, we will notify you through the app or by email
• Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms

If you do not agree with the changes, you must stop using the Service and delete your account.
